I think he should just make it similar to Starfox, but have a different story
and stuff.  Otherwise, it would totally suck if he did it exactly like it.
Just think about when people try to steal stuff from your
website/game/whatever.  Don't you just hate that?  Put yourself in Nintendo's
shoes for a moment.
