If Affinix is a legal entity with proper copyrights then the program and 
source code are effectively owned by Affinix regardless of who worked on 
them.  A lack of a non-disclosure agreement does not mean you can steal 
copyrighted property.

However, if Affinix is merely a "group" and not an incorporated company then 
he's pretty much free to do what he wants if no contracts are involved...
